Terms of Service

By accessing OnlyDeal, you agree to these Terms. If you do not agree, you must stop using the platform immediately.

**Service Provider:** ONEPHONE APPS is now operating as NEUROBYTE ENTERPRISE S.R.L., registered in Romania (CUI 51621428, J2025026576009).

OnlyDeal provides digital hosting, intermediation, promotion, assisted payment, escrow, and related tools; unless expressly stated otherwise, it is not a party to the sale contract concluded between users.

You must be legally able to enter a binding contract and provide accurate account information.

You are responsible for account credentials, account activity, and keeping contact/security details up to date.

We may request identity checks, proof of trader/professional status, tax information, proof of source of goods, or other reasonable information for compliance, fraud prevention, and platform safety.

The contract for the listed good or service is generally concluded directly between buyer and seller. The seller alone is responsible for the existence, ownership, legality, safety, authenticity, description, warranties, delivery, and conformity of the good, as well as for mandatory information required by law.

The buyer is responsible for reviewing the listing, seller status, applicable commercial terms, compatibility of the item, and timely reporting of issues within protected flows.

We do not control or guarantee every listing, communication, or transaction and do not become the agent, mandatary, distributor, bailee, or insurer of any party merely by operating the platform.

You must not list illegal, unsafe, counterfeit, misleading, or stolen goods.

You must not bypass platform protections (including escrow and dispute tools) by forcing off-platform payment/contact.

Sellers must accurately describe goods, disclose material defects, correctly state whether they act as professional traders or private individuals, and must not mislead users regarding origin, condition, warranty, accessories, or title.

You must not copy, republish, or import listing content from third-party platforms unless you own it or have explicit legal rights/permission to use and republish that content.

You must not use bots, crawlers, scraping, data-mining, or other automated means to extract marketplace content or data without our prior written authorization.

Applicable buyer/seller fees are shown before checkout or listing actions are confirmed.

OnlyProtect/escrow flows, refund handling, and dispute mediation follow the policies published at checkout and in legal pages.

Where required by law, we display or may display information about seller status (for example, private individual or professional trader), which party is responsible for certain consumer rights, and the fact that some statutory protections may depend on that status.

Listing visibility in feeds, search, and other surfaces may depend on criteria such as relevance to the search and category, freshness, availability, completeness of information, account performance and reliability, proximity, popularity, quality and engagement signals, as well as paid promotion options or properly disclosed commercial labels.

We may refuse, delay, limit, cancel, or condition a transaction, payout, refund, promotion, or access to certain features where necessary for verification, fraud prevention, legal compliance, enforcement of these Terms, or protection of users and the platform.

Except where mandatory law requires otherwise, fees for services already performed by us may be non-refundable.

You are responsible for listing content, authenticity claims, and legal compliance of goods/services offered.

By publishing content, you represent and warrant that you own the content or have all rights and permissions needed to publish it on OnlyDeal and to grant us a non-exclusive license to host, display, process, and distribute it for operating the platform.

If we receive a credible rights-infringement notice or detect likely infringement, we may remove or disable access to content, request proof of rights, and apply account restrictions.

We may moderate, restrict, delist, demote, disable, suspend, or terminate content/accounts for policy, safety, fraud, legality, trust, risk of harm, repeated intellectual-property violations, or non-cooperation with verification requests.

Where required by law and where circumstances permit, we will provide prior warnings, the main reasons for the decision, and a reasonable path to challenge the measure through the support page or another electronic channel designated by us. We may omit prior warning or accelerate action where there is fraud risk, risk of harm, legal obligation, serious abuse, or security necessity.

To maintain platform security, reliability, and fraud prevention, we may process strictly necessary technical/service telemetry (including request metadata and security signals) even where optional analytics/marketing consent is not granted.

You agree not to interfere with security controls, monitoring systems, anti-abuse tooling, or incident response measures.

You agree not to probe, scan, harvest, scrape, or systematically collect data from OnlyDeal services, including listings, user profiles, and metadata, except where expressly permitted by us in writing.

**Disclaimer:** The platform is provided 'AS IS'. NEUROBYTE ENTERPRISE S.R.L. disclaims all warranties, express or implied.

**Liability Cap:** To the maximum extent permitted by law, our liability is limited to the greater of (a) the fees you paid to us in the last 12 months or (b) 100 EUR.

We are not liable for goods sold by third parties, seller statements, users' non-compliance with legal obligations, or indirect losses, lost profits, lost opportunities, reputational harm, or data loss, to the extent permitted by law.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer rights.

You agree to indemnify and hold harmless NEUROBYTE ENTERPRISE S.R.L., its affiliates, directors, and personnel from any claims, fines, costs, losses, or expenses arising from your breach of these Terms, breach of law, infringement of third-party rights, content you publish, or abusive use of the platform.

These Terms are governed by Romanian law, without prejudice to mandatory consumer protections under applicable EU law.

Where required by law, consumers may use competent authorities, applicable ADR mechanisms, or competent courts.
